These Terms govern your access to and use of the Site. They do not govern the kn0w Audit, the issuance of any Statement, or the conferral of Standing — each of which is governed by separate written Engagement Terms.
This website, kn0w.co (the "Site"), is operated by KN0W PTE. LTD., a company incorporated in Singapore (UEN 202615303G) with its registered office at 160 Robinson Road, #14-04, Singapore Business Federation Center, Singapore 068914 ("kn0w", "we", "us", "our").
kn0w LLC, a Wyoming (USA) limited liability company (Registration ID 2026-001947286), is an affiliate of KN0W PTE. LTD. and acts solely as a technical sub-processor to KN0W PTE. LTD. kn0w LLC does not contract with clients and is not the operator of this Site.
These Terms & Conditions ("Terms") govern your access to and use of the Site, including the Benchmark Preview (defined below). By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms govern use of the Site only.
The kn0w Audit, the issuance of any Statement or kn0w Position, the conferral and maintenance of Standing, the Annual Statement, and the contribution of data to the kn0w benchmark are each governed exclusively by separate written agreements between KN0W PTE. LTD. and the relevant client (together, the "Engagement Terms"), including the Services & Pricing Agreement and the Data Contribution Agreement. If there is any inconsistency between these Terms and the Engagement Terms, the Engagement Terms prevail for the matters they govern.
Nothing on this Site constitutes an offer capable of acceptance. Engagement of kn0w occurs only upon execution of the Engagement Terms.
4.1 Statements are findings. Any Statement, kn0w Position, score, band, benchmark figure, or assessment referenced or displayed on this Site is a finding as at its stated issue date, derived from the evidence provided in the written and verbal interviews conducted in the kn0w Audit and from information available to kn0w at that time, including information provided by the audited organisation. kn0w does not independently verify the accuracy or completeness of information provided to it, and no Statement is a warranty, guarantee, or representation as to any organisation’s actual state of affairs.
4.2 Issued, not advised. kn0w does not provide legal, financial, investment, accounting, tax, or regulatory advice. No Statement, kn0w Position, Benchmark Preview output, or other Content is a recommendation to engage, transact with, invest in, contract with, regulate, or rely upon any organisation, or a recommendation to take or refrain from any action.
4.3 Not a certification or guarantee. A Statement is not a certification, accreditation, licence, or warranty of compliance with any law, regulation, or standard, and is not a prediction or guarantee of any organisation's future conduct, performance, security, or regulatory outcomes. kn0w is not endorsed, accredited, or approved by any regulator. A Statement is the Issuer's view of where an organisation's posture maps to named published regulatory expectations on the day it was issued. A point-in-time Statement speaks only as at its issue date and is not updated unless expressly stated.
4.4 No fiduciary duty. kn0w is not your adviser and owes no fiduciary duty to you or to any visitor to this Site.
4.5 Independent judgment required. You are responsible for your own evaluation of any organisation, and should obtain your own professional advice before making decisions. Content on this Site is not a substitute for the skill and judgment of you or your advisers.
5.1 Statements are issued to, and may be relied upon only by, the named recipient(s) identified in the Statement and the Engagement Terms, and only subject to those terms.
5.2 If you encounter a Statement, a kn0w Position, an excerpt, a badge, or a claim of Standing on this Site or anywhere else, and you are not a named recipient, you may not rely on it, and kn0w accepts no responsibility or liability to you in connection with it, to the maximum extent permitted by applicable law.
5.3 Verification of whether an organisation holds current Standing may be made only through kn0w directly.
6.1 The Benchmark Preview is provided free of charge, for general informational purposes only.
6.2 The Benchmark Preview does not produce, contain, or constitute a Statement or a kn0w Position. No kn0w Position is rendered, displayed, or implied on or through the Benchmark Preview. Outputs are indicative, unverified, generated from self-reported inputs, and have no Standing.
6.3 Benchmark comparisons are generated only from aggregated data and are subject to a minimum cohort threshold, below which no benchmark output is produced. The applicable threshold is described in our Privacy Policy.
6.4 You agree not to: submit another organisation's information without authority; submit false or misleading information; use automated means to probe, enumerate, or reconstruct the Benchmark Dataset, scoring logic, or cohort composition; or attempt to identify any contributing organisation.
6.5 Handling of information you submit to the Benchmark Preview is described in our Privacy Policy.
7.1 We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site and Content for your internal, informational purposes, conditional on compliance with these Terms.
7.2 You must not, except as permitted by law that cannot be excluded:
7.3 We may suspend or terminate access for breach, and may modify, suspend, or discontinue the Site or any feature at any time.
8.1 All Content, and all intellectual property in the kn0w Audit methodology, the six scoring dimensions and their weightings, the deterministic scoring engine, the CEO Visibility Gap and other proprietary gap formulae, the cohort and k-anonymity methodology, the anonymisation pipeline, the Statement identifier scheme, the kn0w Position instrument, the Benchmark Preview, the Benchmark Dataset, and the kn0w name, wordmark, hallmark, and associated branding, is owned by KN0W PTE. LTD. or its licensors. All rights reserved.
8.2 "kn0w" and associated marks are trademarks of KN0W PTE. LTD. No licence to use any mark is granted by these Terms.
8.3 Display of a Statement, a kn0w Position, Standing, or any kn0w mark by a client is governed exclusively by the Engagement Terms.
8.4 Aggregated and anonymised data. kn0w may create, use, retain, and license to third parties aggregated and anonymised data derived from engagements and from Site use, including the Benchmark Dataset, provided such data contains no personal data and does not identify any organisation. The handling of personal data is governed by our Privacy Policy.
8.5 If you provide feedback or suggestions about the Site, we may use them without restriction or obligation.
The Site may link to third-party websites or materials. These are provided for convenience only. We do not endorse and are not responsible for them.
kn0w currently operates in Australia. Our collection and handling of personal data in connection with the Site is described in our Privacy Policy, which forms part of these Terms. The Privacy Policy sets out, among other things, where data is hosted, how cross-border disclosures are handled, and our position on US legal process. Data residency and processing commitments applicable to client engagements are set out in the Engagement Terms and the Privacy Policy.
11.1 To the maximum extent permitted by applicable law, the Site and all Content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency, or uninterrupted availability.
11.2 kn0w does not warrant that Content is free of errors or omissions, and may correct, update, or remove Content at any time without notice.
11.3 Consumer-law carve-out. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under applicable law that cannot lawfully be excluded, restricted, or modified — including, where applicable, guarantees under the Australian Consumer Law, statutory rights under the UK Consumer Rights Act 2015, and equivalent protections in other jurisdictions. Where liability for breach of a non-excludable guarantee can lawfully be limited, our liability is limited, at our option, to resupply of the relevant services or the cost of resupply.
12.1 To the maximum extent permitted by applicable law, kn0w, its directors, officers, employees, contractors, and affiliates (including kn0w LLC) are not liable for any indirect, incidental, special, consequential, punitive, or exemplary loss or damage, or any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or in connection with use of, or inability to use, the Site or any Content, whether in contract, tort (including negligence), statute, or otherwise, even if advised of the possibility.
12.2 To the maximum extent permitted by applicable law, kn0w's total aggregate liability arising out of or in connection with the Site and these Terms is limited to SGD 100.
12.3 Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded by applicable law (including, in the UK, liability for death or personal injury caused by negligence).
12.4 For the avoidance of doubt, any liability of kn0w in connection with a kn0w Audit, a Statement, a kn0w Position, Standing, or the Annual Statement is governed exclusively by the Engagement Terms, not these Terms.
To the maximum extent permitted by applicable law, if you use the Site for business purposes you indemnify kn0w against loss, damage, and costs (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Site, except to the extent caused by kn0w's own negligence or wilful misconduct.
The exclusions and limitations of liability in clauses 5, 11, and 12 are intended to benefit, and are enforceable by, KN0W PTE. LTD., kn0w LLC, and their respective directors, officers, employees, and contractors. Except as stated in this clause, a person who is not a party to these Terms has no right to enforce any of them.
15.1 These Terms are governed by the laws of Singapore.
15.2 The courts of Singapore have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.
15.3 Mandatory consumer protections of your place of residence that apply notwithstanding a choice of law are not displaced by clause 15.1. Where the law of your place of residence gives you a non-excludable right to bring proceedings in the courts of that place, clause 15.2 does not remove that right.
16.1 Changes. We may amend these Terms at any time by posting the amended Terms on the Site with an updated "Last updated" date. Continued use after posting constitutes acceptance.
16.2 Severability. If any provision is invalid or unenforceable in a jurisdiction, it is severed for that jurisdiction to the minimum extent necessary, and the remainder continues in force.
16.3 No waiver. A failure to enforce any provision is not a waiver.
16.4 Assignment. We may assign or novate these Terms to an affiliate or successor. You may not assign them.
16.5 Entire agreement (Site only). These Terms, together with the Privacy Policy, are the entire agreement between you and kn0w regarding use of the Site. They do not supersede or modify any Engagement Terms, which govern the matters set out in clause 2.
16.6 Language. These Terms are drafted in English. Any translation is for convenience only; the English version prevails.
